California Motorcyclist Rights

Motorcyclists have the same rights to pursue personal injury suits as other motor vehicle operators. In California, including Santa Rosa and Sacramento, motorcycle accident laws protect the motorcyclist when injured. The state has a number of motorcycle laws to safeguard the motorcyclist on the road and help prevent accidents. These laws require the following:

  • Safety helmet
  • State-funded rider education for eligible applicants under the age of 21
  • Daytime use of headlights
  • A left or a right mirror
  • Muffler
  • Passenger seat and passenger footrest if you are carrying a passenger
  • Periodic safety inspection
  • Use of turn signals
  • California state insurance for compulsory liability at the minimum limits
Further, the state places restrictions on helmut earphones, sound levels, and handlebar height.

As in other motor vehicle accident lawsuits, the motorcyclist as plaintiff must prove negligence on the part of the other operator and demonstrate that this negligence caused injury. In about 75 percent of motorcycle accidents, including Sacramento motorcycle accidents, another vehicle is involved and at fault.
